Many consumers confide that buying a vehicle is one of the worst experiences of their life. Frequently, they come into my office and they are embarrassed and ashamed of the situation in which they have found themselves.
When one understands how a car dealership sells cars, there is a complete understanding of the circumstances leading to a vehicle purchased and there should be no reason to be embarrassed. Quite frankly, people do not understand the extensive processes at work when buying a car. Actually, the appropriate statement would be most people do not understand the processes at work used by a dealership to force the sale of vehicles. This process has been honed for many years for which the dealership employees at all levels have been trained. All levels of dealership employees including salesman, sales manager, finance and insurance managers, general managers and other owner representatives have been extensively trained in the process of selling cars.
The process starts in the advertisement. Nowadays, the internet, in my opinion, has overtaken the use of newspaper advertisements. This is step one to get interest in a vehicle whether it be through the internet or through newspaper advertisement or TV. The next step is to get the person into the dealership when they can use their training and skills to 'convince' a potential purchaser to purchase a vehicle. There are many tools that they use to gain a consumer's confidence and trust the dealership representatives in the sales process. However, this is completely phony and consumers need to understand that they cannot trust these representatives in any way, shape or form. These representatives are using this trust as a coercion factor to get them to purchase vehicles.

The department's main offices are located at Mary Roebling Building at 20 West State Street in Trenton, New Jersey. Today’s online US News & World Report contains a good piece on five definite warning signs of bad cars. It’s worth reprinting and reading. Here’s the article…

If only cars could talk. It would make the buying experience a lot easier, wouldn’t it? Because verbalized or not, every used car has a story to tell. And to avoid getting ripped off, it’s up to you to listen. You need to know about the skeletons in that car’s closet, the dark secrets of its past.

There are so many problems that can hide easily under the surface — accident damage, a counterfeit title, failing mechanical parts. It’s not as if you’re marrying the car, but you are making quite a financial commitment. Wouldn’t you rather find out about these red flags before saying “I do” and plunking down your hard-earned cash?

With this list of warning signs, you’ll be able to make your next used car purchase confidently — and if you do find “the one,” we’ll bet the relationship won’t end in a messy divorce.

Red Flag #1: No Service Records

One of the most important aspects of a used car is its maintenance history. You want to make sure you’re buying a vehicle that has had routine oil changes and major mileage services. Always ask the seller, even if it’s a car dealership, for all service records. If they can’t provide those for you, you have no way of knowing if the car has been maintained properly. In addition to asking for records, look for a windshield sticker indicating when the car’s next oil change is due. If there’s no sticker or it shows an oil change is past due, ask why.

Red Flag #2: Vehicle and Accident History Issues

A vehicle history report is essential for any car purchase. You can ask the seller or dealership for the report or access it yourself online using the car’s VIN (Vehicle Identification Number). AutoCheck charges $19.99 for a single report or $29.99 for unlimited reports for 60 days. The report shows accident/damage history as well as title problems, frame damage and an odometer rollback check — any of which should be deal breakers.

Red Flag #3: Mechanical Problems

A quick look under the car can reveal fluid leaks, but unless you’re an expert, you’ll need to have someone else do a thorough inspection to make sure it’s in good working condition. A PPI, or Pre-Purchase Inspection, is performed by a neutral third party (such as a certified mechanic or automotive technician) and costs about $100 to $200.

The inspection is a detailed assessment of the cosmetic and mechanical condition of the vehicle. It is an invaluable asset since it can alert you to problems, maintenance issues and even frame damage hiding under the surface. The mechanic should put the car on a lift to check undercarriage components. Make sure he or she also uses a paint meter gauge to catch any re-painted body panels — which mean the car may have been in accidents that weren’t reported to the insurance company (if they had been reported, they would show up on your AutoCheck vehicle history report). Choose the party who will perform the inspection, rather than going with someone recommended by the seller. Ask to have the results sent directly to you.

You may be tempted to skip a PPI, but it’s almost always well worth it. You’re making a large investment in a vehicle, and the price of the PPI is only a very small fraction of that. If any problems the PPI shows are deal breakers, you can walk away from the sale. If not, you can still use them to negotiate a better price.

Red Flag #4: A Problem Title

Your AutoCheck vehicle report will show any problem titles on the car’s record at any point in its history — everything from hail damage to fire damage. Most of these issues are red flags, but here’s just a sampling of those to avoid at all costs: Flood titles, which means the vehicle has received extensive water damage; salvage titles, which mean an insurance company has at some point declared the car a total loss due to sustained damage; and junk titles, which mean the vehicle indicate that a vehicle is not safe enough for use and the car cannot be titled again in that state.

Red Flag #5: A Fraudulent Title

A problem-free title doesn’t mean it’s valid. Criminals can create counterfeit or fraudulent titles and use them to legally register and then sell stolen cars. If you buy a car without a valid title, it’s the worst-case scenario — you don’t legally own the car you just bought.

The first step to verify the title is to check with the DMV. Usually, you’ll just need the car’s VIN number and may be charged a small fee (often these transactions require you to go to the DMV’s office). You need to make sure the VIN on the car matches the VIN on the title and the seller’s name matches the one on the title. This record check is also valuable because it will show any outstanding liens on the title, which means that the owner is still making payments on the car and doesn’t own it outright. This could complicate the sale later, especially if you’re buying from a private seller.

However, even if the title appears to belong to the seller, it could still be fraudulent. There are a few signs that may signify foul play. Play close attention if the vehicle was recently brought to your state and titled or if the VIN number on the car is obscured or shows signs of tampering. The title should look official, meaning it will be printed on special paper with watermarks (visible when held up to the light). All text, graphics and borders should be sharp, not blurred. If you can, compare the title with an original (perhaps from a friend’s car in the same state) and make sure the two look the same.

The Bottom Line

Checking for all these red flags may seem excessive, but they can save you time and headaches down the line. In the end, the PPI, AutoCheck vehicle history report, DMV records and seller should be consistent. If any of the information seems fishy, consider walking away from the sale. If any of the above warning signs do surface, you may not even want to give the car a second thought. It doesn’t hurt to walk away, but it can sure hurt a lot to buy a problem vehicle. Plus, with the internet, you can find virtually any car, anywhere. And as they say, there are plenty of other fish in the sea.

Top Lemon Laws Consumers Should Know About

Lemon laws protect car buyers who have repeatedly tried to fix cars, to no avail. While laws vary by state, one of the strongest is the Texas lemon law, on which other state laws are modeled. There are also federal laws that further protect consumers. Consumers can use these lemon laws to get a refund or replacement for cars that require excessive repairs to fix warranty-covered problems.

Texas Lemon Law: The law applies to new automobiles, trucks, motorcycles, all-terrain vehicles, RVs, and towable recreational vehicles. These vehicles must have problems covered by a written factory warranty; claims must be filed within 6 months of the expiration of the warranty, 24 months, or 24,000 miles, whichever comes first. The law requires 2 repair attempts in the first 12 months or 12,000 miles and another 2 attempts in the second 12 months or 12,000 miles. If the problem is a serious safety hazard, it only requires 1 repair attempt in the first 12 months or 12,000 miles and at least one more in the second 12 months or 12,000 miles. The law also covers vehicles that are out of service for 30 days.

California Lemon Law: This law applies only to vehicles used for home or personal use. It requires 4 repair attempts or 30 days out of service within 18 months or 18,000 miles. If the problem could cause death or serious injury, it only requires 2 repair attempts.

Florida Lemon Law: This law applies only to vehicles used for home or personal use, but doesn't cover off-road vehicles, motorcycles, mopeds, or trucks that weigh over 10,000 pounds. Claims must be filed within 24,000 miles of the vehicle's delivery, with at least 3 repair attempts or 30 days out of service.

Idaho Lemon Law: It covers all new vehicles, whether for personal or business use, but doesn't cover motorcycles, farm equipment, trailers, or vehicles over 12,000 pounds. It requires 4 repair attempts or 30 business days out of use within 2 years, 24,000 miles, or the expiration of the warranty.

Uniform Commercial Code, Article Two: This is a federal statute that affirms the consumer's right to a replacement vehicle if they have complied with all procedures to replace a vehicle.

Magnuson-Moss Warranty Act: This federal statute protects consumers from companies that won't fulfill the warranty terms. Significantly, it applies to used cars with a warranty, requires companies to redress problems within a reasonable amount of time, and allows consumers to recover attorney's fees. The latter puts pressure on companies to resolve issues before they reach court.

Naturally, the ideal situation would be not to purchase a lemon in the first place. To avoid buying a lemon, buyers should research both the cars and car dealerships to find out about common problems and others' experiences. A third-party mechanic's review may also be helpful before purchase. But if a buyer does end up with a lemon, he or she can take some meager comfort in the fact that lemon laws allow them some recourse.

Hyundai Lemon Law case over attorney fees

Hyundai recently lost a California Lemon Law case over attorney fees in the Court of Appeals of California -- Fourth Appellate District. The case revolves around Adina Vasquez's purchase of a defective 2005 Hyundai Sonata. Vasquez hired a lemon law attorney and sued under the California Song-Beverly Act and the Magnuson-Moss Act.

Vasquez was able to get a repurchase on the vehicle, but the issue of attorney fees remain pending. Thereafter, Vasquez's attorney sued for attorney fees in the amount of $51,012. Hyundai fought and the trial court agreed with Hyundai -- it refused to award any attorney fees to Vasquez's attorney. Vasquez's attorney took the case to the Fourth Appellate District Court of California.

In its unpublished decision dated on October 13, 2009, the appellate court sided with Vasquez in stating that Vasquez's attorney is entitled to "reasonable attorney fees." The case is remanded back to the trial court to determine the reasonableness of $51,012.

Often times, potential clients will call me with a set of facts that meets the minimum requirements of the Texas Lemon Law. However, once I ask the potential client to fax me the repair invoices, I learn that the receipts were either inaccurate or unavailable.

Many dealerships, in preparation for a lemon law claim, would find ways to set up the situation against the consumer's favor. For example, the repair invoice always includes the legal jargon that the "customer states...." so-and-so. It never states that "we the dealership found or discovered a serious defect: -- because that would be considered an admission to liability.

Other times, the dealerships will merge two separate repair visits onto one invoice. In the eyes of most Texas Lemon Law administrative judges, one repair invoice equals only one visit. The rule of thumb is that once you've driven the car off the lot for a repair invoice and the same problem re-manifests itself, then you should turn around, have the dealership attempt to repair the defect and request a separate repair receipt.

Another inaccurate repair invoice situation is when the dealership mis-types that mileage in and mileage out area of the repair invoice. I have had a client that noticed that the odometer had 400 miles added to it when it was in the possession of the dealership. The repair invoice indicated that only 4 miles were driven.

Like anything, if you notice that the repair invoice is not accurate, then DO NOT sign the repair invoice.

Governor Signs Car Buyers Protection Bills

Gov Schwarzenegger signed two car buyer protection bills. Given the fact his own administration had publicly opposed them both, this is a stunning reversal. Senate Bill 95(Corbett) will require auto dealers to pay off liens on cars that were traded in with negative equity, before they can sell or transfer them -- which usually happens within a day or two -- or within 21 days (if they keep them that long). The auto dealers and their trade associations were hugely opposed to this bill -- especially the provision for pay-offs prior to resale.

Assembly Bill 647 (Yamada) will require the CA DMV to allow public access to the
national database of totaled/wrecked/stolen autos (NMVTIS), and to comply with the federal Anti-Car Theft Act.

Both bills were sponsored by CARS, a non-profit run by Rosemary Shahan. Rosemary was in large part responsible for the passage of these bills into law.

Consumer Fraud and the Uniform Arbitration Act

As previously stated in many of these posts, the dealers frequently use arbitration agreements as a method by which they bypass the court system. There are numerous organizations including JAMS, NAF and American Arbitration Association. All of these organizations ordinarily have consumer due process protocols for these arbitrations. The question is what happens when you win an arbitration and the dealership refuses to pay the arbitration award. Unfortunately, this is not an easy process but there is a provision in the Uniform Arbitration Act for the Superior Court to confirm an arbitration award entered by an arbitrator. Basically, the petitioner must file an order to show cause (fancy words for a court action) to confirm the arbitration award so as it can be entered into the docket system and be docketed against the dealer's property. There is an entire provision under the court rules for a filing of an order to show cause and is relatively complicated. Nonetheless, the Court is permitted to confirm this arbitration award so long as there is not a basis to vacate the arbitration award filed by the loser of the arbitration. Once the arbitration award is confirmed by the Superior Court, it becomes a judgment docketed and the petitioner or plaintiff may use this docketed judgment or award as any other docketed judgment or award. Moreover, the Uniform Arbitration Act provides for the payment of counsel fees and costs associated with domesticating or confirming an arbitration award. The New Jersey Consumer Fraud Act also provides for the payment of counsel fees with the collection of a consumer fraud judgment. This was decided in the case of Tankersley wherein the Appellate Division held that an attorney who was attempting to collect judgment on a consumer fraud award would be entitled to counsel fees and costs. The Tankersley case involved the collection of a judgment against a car dealership.

Is it identity theft or is it bank robbery --- and whose fault is it?

We've talked before about identity theft and its dangers and lots of people have. There's even a terrific British Youtube about it and the puzzling question of whether it is really identity theft at all (or is it just electronic bank robbery?). Well maybe we're about to find out.

Patco Construction Company, Inc. v People's United Bank dba Ocean Bank, no pending in state court in Maine, may tell us just whose fault it really is, besides the cyber criminal of course.

Patco was a long time customer of the bank but after losing hundreds of thousands of dollars from online theft and then getting a notice from the bank that they wanted Patco to pay it back, they decided they had enough. Patco sued the bank for the loss. 'bout time, some would say. So would I.

While the claims include negligence, breach of contract, breach of fiduciary duty, and more (what, not bailment?), fundamentally the theory is that the bank failed to live up to its most basic obligation, which is to protect its customers' funds from theft. Patco's case is one to watch. With the increasing rise of cyber theft, sooner or later it may happen to you.

The Patco bank's claims of sophisticated "behind the scenes" security measures and computer programs didn't do much good to stop cyber thieves who dipped not only into Patco's accounts, but did so repeatedly, transferring money to accounts that Patco had never used before, and from internet addresses that Patco had never used before either. The thieves even managed to tap into Patco's line of credit for a hefty $200,000 transfer.

When you think about it, Patco's claims make sense. All banks are quick to point out, on their websites and in their paper brochures, how they have all these computer theft protection measures set up to protect your deposits from theft. Much of it is advertising directed at encouraging consumers to use the internet for electronic transfers and bill paying that are high-profit transactions for the banking industry. After all, there aren't many tellers working inside that big bank computer box. Heck, there's even fewer of them at the walk in windows nowadays.

A century or two ago people put their money under the mattress or buried it in the backyard because that was safe. Now when you put your money in the bank, it's because you think it's safe. Well, not quite as safe as it used to be.

Still, if you give a friend $50 to hold for you, it's only natural to expect that they'll have it on hand to give back to you when you ask for it later. Especially if that "friend" is a big bank that collects millions of dollars from thousands of people and then invests it and charges interest on loans and makes money off your money (which they keep). That's a simple idea that any person can grasp.

You expect the bank to protect your money and when they don't, it doesn't really matter whether they had one computer program to stop cyber thieves or a hundred of those programs. When the money is gone, it's gone. But it ought to be the bank's fault.

So let's stop calling it identity theft and call it what it is. Bank robbery. As soon as the banks are forced to stop charging customers for their own account keeping negligence, they will start trying to stop the problem. Sooner or later the bank will decide it needs to fix it so cyber theives can't get into your account.

So when will that happen? When we all make it happen. Banks don't like losing money and they don't like paying out money either. When it starts costing them money, they'll do something about it. Until then, they will keep tellling you that it's "your" identity theft problem and that it was "your" money that was stolen and not theirs.

How Patco's case comes out will be very interesting. But, one thing is for sure, the rest of us will be watching. And you can bet that the banks will really be watching.

Formaldehyde in the Fall, on sale now

Hurricane Katrina was a disaster for Mississippi and thousands are still affected, with populations shifted and the landscape scarred still. One thing it made the public more aware of, however, was not in the wind that day.

After Katrina left the coast and dissipated, and FEMA finally got into gear, the federal government bought thousands of trailers from RV manufacturers for temporary housing for the thousands of displaced homeless families who had lost everything in the storm. For everyone at the time, it seemed like a blessing. The reality was something else.

With most of the trailers, if not all of them, came the smell of death. Now, it's on sale.

Acres of trailers, 483 of them in Brooklyn, are being sold at an online auction by the federal agency charged with disposing of surplus government property. And the sale closes October 2.

"We're trying it out to see how it goes," said Alicia Paris, an administrative assistant who transferred from the Federal Emergency Management Agency's Gulfport office to help with trailer sales. Paris described the lot being sold at Carnes as "7's," which in government-talk means they think the formaldehyde-laden trailers are repairable and can be used as "temporary housing."

Of course, the folks who think these trailers are repairable and livable are the same folks who didn't even see Katrina coming, so you know what that's worth.

As sales go, this one is small. It's only 483 of the estimated 35,000 that were still left over earlier this year, nearly a third of which are located around Columbia, Mississippi. People stopped buying the trailers in 2007 when word leaked out about the heavy dose of formaldehyde that was used in the trailer construction and its ill effects on people living in the trailers without knowing about it.

Turns out, though, that this is all a bit of a blessing in disguise. Congressional investigations and lawsuits have now turned up evidence that the Rv industry has for decades used formaldehyde in construction of trailers, mobile homes, Rv's, motor coaches and other occupational use. None of it was widely known until Katrina came to town. The publicity was so bad that now one company has even started building Rv's that are "green" and promise no formaldehyde use at all and others have promised to cut back on formaldehyde use. That's good for everyone. Especially owners.

Toyota has recalled 3.8 million vehicles in what is the largest recall it has ever done. Apparently floor mats can get jammed at the gas pedal, causing the engine to accelerate uncontrollably, during which the engine can not be shut down.

The recall was prompted by years of runaway accelerator complaints and investigations that culminated in the August death of a highway patrolman and 4 passengers in a Lexus being driven by the officer. The passengers called 911 just minutes before their death in a violent 120 mph crash, saying that the accelerator had become stuck and the car would not shut off.

Officials suspect the driver side floor mat became lodged at the gas pedal with the accelerator in a wide open position.

Toyota admits to reports of the problem going back to its 2004 model year Prius. Federal safety officials say they received 102 reports of jammed accelerators in Toyota and Lexus models that resulted in at least 13 crashes and 17 injuries before the August crash that killed the off-duty California Highway Patrol officer.

Toyota reportedly has said that all driver side floor mats should be immediately removed from vehicles and nothing should be used, not even paper mats, until they come up with a solution.

Differences between theTexas lemon law and Toyota's safety recall

Toyota recently issued a safety recall to address its vehicles' abnormal acceleration while in operation. This will be considered one of Toyota's largest recall and perhaps most costly recall in the United States relating to the safety of the vehicle.

The reason why this recall is considered so massive is because it applies to numerous Toyota models, including the ever popular Camry, Avalon, Prius, Tundra, Tacoma, and Lexus.

The actual recall itself is still pretty vague. Toyota's current recommendation is to remove the floor mat underneath the accelerator to prevent it from sticking between the gas pedal. Toyota still has not issues any official notice for a permanent fix.

Why is Toyota issuing this recall, rather than not doing anything and waiting for consumers to file lemon law claims? Well, Toyota has known about this problem since 2004, when Toyota drivers reported numerous crashes and injuries due to uncontrollable acceleration. Toyota waited Five years later, right up until the National Highway Traffic Safety Administration (NHTSA) finally issued a warning. (Talk about red tape and bureaucracy in action)!

So, how is a safety recall such as this one different from a lemon law claim in Texas? Both situations pertain to defective cars. However, in a safety recall, the car manufacturer is the entity that proactive will correct the defect. In a lemon law claim, you would have to assert your right through the administrative process, or sue under consumer protection laws such as the Magnuson-Moss Warranty Act or Texas Deceptive Trade Practices Act. Also, a lemon law claim is usually smaller scale, while a safety recall involves several hundreds of thousands, if not millions of cars.

Here's the kicker...Irv Miller, Toyota's spokesman, really shows how much he cars about consumer safety by saying that if Toyota owner's can not remove the floor mat, then they should merely "step" on the brake pedal with both feet until the vehicle slows. Right,...because stepping on the brake pedal with one feet is obviously not enough.

Appearance Package, Wheel Well Molding, Door Edge Guards

Some dealerships use the sale or attempted sale of door edge guards, wheel well molding or pin striping commonly known as appearance packages to increase the costs of the vehicles. Frequently, these pre-delivery services are not included anywhere in the buyer's order but only on a price addendum placed on the automobile. New Jersey law is relatively straightforward and requires a consumer to sign off and acknowledge the purchase of any pre-delivery services on the sale of an automobile. Dealership uses the guise of these expensive products. These products increase the "sticker" price of a vehicle. When the customer sits downs and looks all the paperwork, it is not apparent that these items are included the price anywhere. This is the intention behind the New Jersey Consumer Fraud Act and the associated Administrative Code regulations requiring consumers to acknowledge purchase of pre-delivery services. Even if these were considered aftermarket items or different types of products, it would still be appropriate for the dealer to disclose the nature and extent of these products, any warranties that were associated with these products and the costs thereof. Best advice would be to be very careful in the injunction of negotiating a purchase price on a new vehicle and demand for an itemization of any and all products and/or services that you are acquiring or think you are acquiring as part of the automobile purchase. The dealership is required to disclose this to you fully and honestly and the best way to do this would be to bring a piece of paper where the dealership would sign off on the specific products which you are purchasing. This would forego any potential confusion and document exactly what you are and are not purchasing.
